Last updated: October 23, 2026
OVERVIEW
This website is operated by He Calling Us. Throughout the site, the terms "we", "us" and "our" refer to He Calling Us. He Calling Us is an independent music label and a faith-based apparel brand. We offer this website, including all information, tools, products and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site, purchasing from our store, requesting a quote, submitting a demo or hiring us for any music service, you agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including the additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including visitors, customers, clients, artists, vendors and contributors of content.
Please read these Terms carefully before using the website. If you do not agree to all of them, you may not use the website or our services.
We may update these Terms at any time by posting the changes on this page. Your continued use of the site after a change means you accept it.
PART 1. GENERAL TERMS (apply to everyone)
1. Using the site
You must be at least the age of majority in your state, province or country of residence, or have the consent of a parent or guardian who is. You may not use our site or services for any illegal or unauthorized purpose, or transmit any virus or destructive code. A breach of these Terms may end your access to our services immediately.
2. General conditions
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, copy, sell, resell or exploit any part of the site, our services or our content without our written permission. Headings are for convenience only.
3. Accuracy of information
Information on this site is provided for general information only. We are not responsible if it is not accurate, complete or current. We may change the content of the site at any time, but we have no obligation to update it.
4. Modifications to services and prices
Prices for our products and services are subject to change without notice. We may modify or discontinue any product, service or part of the site at any time. We are not liable to you or any third party for a modification, price change, suspension or discontinuance.
5. Optional tools and third-party links
We may give you access to third-party tools and links to third-party websites. We do not control them and are not responsible for their content, accuracy, policies or any transaction you make with them. Review their terms before you use them.
6. User comments and submissions
If you send us comments, ideas or materials (other than a demo, which is covered in Part 3), you agree we may use, edit, publish and distribute them without restriction or payment, and without any duty to keep them confidential or respond. You agree your comments will not violate anyone's rights and will not contain unlawful, abusive or harmful material. You are responsible for what you send.
7. Personal information
Your personal information is governed by our Privacy Policy.
8. Errors, inaccuracies and omissions
The site may contain typographical errors or inaccuracies about products, services, pricing, promotions, shipping or availability. We may correct them and change or cancel orders or quotes at any time, including after you have submitted them.
9. Prohibited uses
You may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to break the law; (c) to violate any international, federal, provincial or state regulation or law; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, defame or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, scrape or crawl; (j) for any obscene or immoral purpose; or (k) to interfere with the security of the site. We may end your use of the site for any of these.
10. Disclaimer of warranties and limitation of liability
We do not guarantee that the site or our services will be uninterrupted, timely, secure or error-free, or that results from using them will be accurate or reliable. Your use of the site and our services is at your own risk. Except as expressly stated by us, the site and everything delivered through it are provided "as is" and "as available".
To the maximum extent permitted by law, He Calling Us and its owners, team, contractors, session musicians, suppliers and licensors are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, lost revenue, lost data or release delays, arising from your use of the site, our products or our services. Where the law does not allow this limit, our liability is limited to the maximum extent the law permits, and in any case to the amount you paid us for the product or service that gave rise to the claim.
11. Indemnification
You agree to defend and hold harmless He Calling Us and its owners, team, contractors, session musicians, suppliers and licensors from any claim or demand, including reasonable legal fees, made by a third party due to your breach of these Terms, your violation of any law, or your violation of a third party's rights, including any material you supply to us.
12. Verification and security
To protect transactions on He Calling Us, we may use third-party services to verify your identity. You agree that we may contact you by text message for identity confirmation if we detect possible fraud involving your shipping, billing or payment information.
13. Severability, termination and entire agreement
If any provision of these Terms is found unlawful or unenforceable, it is enforced to the fullest extent permitted and the rest remain in effect. These Terms stay in effect until ended by you or by us. You may end them at any time by telling us you no longer wish to use our services. We may end them or deny access if we believe you have not complied. Obligations incurred before termination survive. Our failure to enforce a right is not a waiver of it. These Terms and the policies posted on this site are the entire agreement between you and us and replace any earlier version.
14. Governing law and dispute resolution
These Terms and any separate agreements whereby we provide you services are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law rules.
If a dispute arises, you agree to contact us first and to try to resolve it informally with us for at least 30 days. If it is not resolved, any dispute arising out of or relating to these Terms, our products or our services will be settled by binding arbitration on an individual basis, administered by JAMS or the American Arbitration Association under its rules, with the seat of arbitration in California. Hearings may be held by video. Either of us may instead bring an individual claim in small claims court. A court with jurisdiction may enter judgment on the arbitrator's award. To the extent the law allows, disputes are resolved only on an individual basis, and not as a class, collective or representative action.
PART 2. STORE TERMS (apparel and merchandise)
15. Products
Our products are made to order with print-on-demand partners, so availability, production and delivery times can vary. We show the colors and images of our products as accurately as we can, but we cannot guarantee that your screen shows any color exactly. We may limit the sale of products to any person, region or jurisdiction, limit quantities, and discontinue a product at any time. Offers are void where prohibited. Returns and exchanges of store products are governed by our Refund Policy, and shipping by our Shipping Policy. The Refund Policy applies only to store purchases and does not apply to music services.
16. Orders, billing and account information
We may refuse, limit or cancel any order, including orders that appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we may try to notify you using the email, phone or billing address you gave us. You agree to give current, complete and accurate purchase and account information and to update it promptly.
PART 3. MUSIC LABEL AND MUSIC SERVICES TERMS
These terms apply when you hire He Calling Us for mixing, mastering, ghost production or music production, when you submit a demo, or when you work with us as a label artist. Deposits, cancellations and refunds for music services are governed only by Sections 19, 20 and 21 below, and not by the store Refund Policy. A written quote, invoice, booking confirmation or contract for a specific project may add to these terms. If it conflicts with them, the project document prevails for that project.
17. Our services
He Calling Us offers mixing and mastering, ghost production, full music production and label releases. Services are delivered online. You send the files and we send back the finished work. The scope, price and delivery date of each project are agreed in writing before work starts. A project begins when we confirm the booking and receive the deposit.
Human-made work. The music, vocals, compositions, arrangements and performances we deliver are created by people. We do not use generative AI to create them.
18. Collaborators and subcontractors
To deliver every project with the right skills and on time, He Calling Us works with independent producers, engineers, session musicians, vocalists, composers, arrangers and other creative professionals ("Collaborators"). By hiring us, you agree that we may involve Collaborators in any part of your project, at our discretion, without prior notice and without naming them. Using Collaborators is part of how our services are delivered, and it is not an option you can exclude.
Our Collaborators may be located in any country. You agree that your project and your files may be handled by Collaborators outside your country and outside the United States, and that files may be transferred across borders for that purpose.
Every Collaborator signs a written work-for-hire agreement with He Calling Us before starting. Under it, the Collaborator assigns to He Calling Us 100% of their rights in their contribution, including copyright, and waives moral rights to the extent the law allows. We require every Collaborator to deliver original, handcrafted work, created by the Collaborator and not generated by AI, and free of third-party copyright claims. This allows us to deliver the finished work to you with the rights set out in your project agreement.
Collaborators are engaged and paid by He Calling Us, at our own cost. Using Collaborators never adds to the price you agreed, and you owe nothing to them. You do not need to contract with them, pay them or deal with them in any way.
Collaborators have no direct relationship with you, and you may not contract with them or instruct them directly regarding your project. We manage our Collaborators and are responsible to you for the work we deliver under your project agreement, subject to the limits in these Terms. Credits for Collaborators, and for you, are decided project by project.
19. Quotes, deposit and payment
-
A quote is valid for 30 calendar days from the date it is issued.
-
A non-refundable deposit of 50% of the project cost is due to confirm a booking.
-
The remaining 50% is due in full before we deliver the final masters.
-
Final files are released only after full payment.
-
All prices and payments are in US dollars (USD).
-
You are responsible for any bank, card, currency-conversion and payment-processing fees, and for any taxes or duties that apply in your country, so that we receive the full amount quoted. If a payment arrives short because of such fees, you agree to pay the difference.
-
If you reverse or dispute a payment with your bank or card issuer without first contacting us, we may pause work and withhold delivery until it is resolved.
20. Cancellations and postponements
If you cancel or postpone a confirmed project, the deposit is not refunded. No further cancellation fee applies. Work already delivered beyond the deposit amount remains payable.
21. Content standards and our right to decline
We may decline, pause or cancel a project, at any time, if the content is illegal, infringes the rights of others, or is hateful, abusive or otherwise offensive. If we cancel a project for this reason, the deposit is not refunded. Any other amount you paid for work that has not yet been performed is refunded. Amounts for work already performed are not refunded.
22. Files you supply
You are responsible for sending the files we ask for, in good quality and in the agreed format. You confirm you own, or have permission to use, everything you send us, including samples, vocals and compositions, and that it does not infringe anyone's rights.
If your files include samples, loops or other material created by third parties, you must tell us and, when we ask, send us proof of the license or permission to use it. We may pause a project until we receive it. You are responsible for any use of unlicensed material.
We do not use your files to train artificial intelligence models. If any part of the material you send was created or altered with AI, you must tell us before work starts. Our human-made commitment in Section 17 applies to the work we create, not to material you supply.
You agree that we may share your files with Collaborators as needed to deliver your project. Delays in receiving files may move the delivery date.
23. Revisions and approvals
-
Changes to the supplied demo or production must be specified and approved before mixing starts.
-
Changes to a mix must be specified and approved before mastering starts.
-
Each project includes 3 revision rounds. Further rounds are charged at our current rates.
-
Once you approve the final masters, the work is accepted. Any later error, including technical or human error in files you approved, is your responsibility and any loss is at your cost.
24. Song length
A song of up to 4 minutes counts as one song. Each additional block of up to 4 minutes counts as an additional song and is charged at the agreed rate.
25. Ghost production: fees and royalties
Ghost production projects are charged a base fee plus royalties of 10% to 20% on the revenue the finished work earns. The royalty percentage, how revenue is calculated, how often royalties are reported and paid, and how and when payment is made are set in writing for each project before work starts. Whether credit is given is also set for each project.
26. Rights and ownership
All contributions made by our Collaborators are assigned to He Calling Us in full under their work-for-hire agreements, so the work we deliver is free of third-party copyright claims from our Collaborators. Ownership of the final master, the stems and any other rights in the delivered work, including the rights we pass on to you, are set out in the written agreement for each project. Unless that agreement says otherwise, He Calling Us may describe the project and, with your approval, show non-confidential work in our portfolio. Songwriting credit and publishing for any melody, chords or lyrics we or our Collaborators contribute are negotiated and agreed in writing between the writers before release.
27. Confidentiality
We handle project files with care and use them only to deliver your project, which includes sharing them with the Collaborators who work on it. We do not offer non-disclosure agreements (NDAs) as part of our standard services, and we do not promise that the existence or content of a project will be kept confidential unless we agree otherwise in writing.
28. Demo submissions
When you submit a demo through our website, you confirm you own or control it and that it does not infringe anyone's rights. Submitting a demo does not create a contract, a promise of a reply or a promise of a release. We may or may not respond. We do not return demos. Your demo is used only to evaluate it unless we agree otherwise in writing. If we want to work with you, we will propose a separate written agreement.
29. Label releases and artist agreements
Releases on the He Calling Us label are governed by a separate written agreement with each artist, which covers rights, royalties, credits and term. Nothing on this website is an offer of a recording contract.
30. Delivery times and file storage
Delivery dates are estimates unless we confirm them in writing, and depend on receiving your files, payment and your timely approvals. We are not liable for delays caused by you, third-party platforms or events outside our control.
We keep the files of your project for 30 days after we deliver the final work. After that period we may delete them, and we are not responsible for providing or recovering them. Download and keep your own copy of everything we deliver.
31. Newsletters and communications
If you give us your email address, you agree to receive occasional informative emails from He Calling Us. We do not give your email address to third parties. You can unsubscribe at any time.
32. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control ("Force Majeure Event"), including natural disasters, fire, flood, pandemic, war, terrorism, government action, power or internet outages, failures of payment, hosting, shipping or print-on-demand providers, and the unavailability of a Collaborator.
Delays. If a Force Majeure Event delays your project or your order, the delivery dates move by the time the event lasts plus a reasonable time to resume. We will tell you as soon as we reasonably can and give you a new estimated date. A delay caused by a Force Majeure Event is not a breach of these Terms, and it does not entitle you to compensation.
Refunds for music services. If a Force Majeure Event prevents us from delivering your project for more than 30 days, either of us may cancel the project by written notice. In that case, whether and how much of the amounts you paid is refunded, including the deposit, is decided case by case, in good faith, taking into account the work already performed and the costs we have already incurred. We will tell you our decision in writing. The deposit rule in Section 20 applies when you cancel or postpone for any other reason.
Refunds for store orders. If a Force Majeure Event prevents us from fulfilling a store order, we may cancel it and refund what you paid for the part we could not fulfill. Returns of delivered products remain governed by the Refund Policy.
A Force Majeure Event does not excuse your duty to pay for work already performed. Delays or failures of our Collaborators are covered by this Section only when the cause is itself a Force Majeure Event, and we remain responsible for arranging replacements where we reasonably can.
33. Changes to these Terms
You can always review the current Terms on this page. We may update, change or replace any part of them by posting the changes on our website. Your continued use of our site or services after a change means you accept it.
